Hello everyone!
I would like to hear your opinion on the following topic.
We plan to build on an already developed plot of land.
Currently, the rear area of the plot is developed. The front, street-facing area is approximately 1000m² and is undeveloped and developable.
We wanted to divide the plot so that two plots are created (a front and a rear one) and the access to the already existing house at the back remains possible via an adjoining driveway.
According to our local building authority, this should not be a problem, so we submitted a preliminary building inquiry.
Now we have received the notice that the preliminary building inquiry has been rejected because this falls under building in the second row.
All the results I could find on this only describe that building in the second row means building in the hinterland.
However, we are building in the front area...
The call to the authority didn’t help me much at first because the person in charge is currently on vacation.
Since this issue is bothering me, I wanted to ask if any of you have already had experience with this and can tell me whether my project actually falls under building in the second row.
