Hello everyone,

I received the following contract (template) from BU. The plot of land is secure. Financing is ongoing, no approval from the bank yet. BU said, can we finalize the contract in such a way that if the house construction is not financed, one can withdraw without any further ado! I actually have no problem with that, since without a contract the construction date will be delayed and the company has announced that new prices will apply from the first of November (2 to 3 percent more). What is in the contract? What do we need to consider? As far as I know, 5% of the construction costs will be paid at the end of the warranty period, but I do not see anything like that in the contract! (I will definitely hire a building expert who will accompany me from the contract to the final acceptance)

Read page 2 of your contract, if necessary get help from a native speaker. Withdrawal costs 4% of the contract sum. In addition, upon conclusion 2% of the contract sum plus VAT have to be paid.

I would not sign this contract. I would also not sign a construction contract with fixed financing for which I have to pay 2% fees.

By the way, I believe that it is better for consumers to conclude contracts according to the Construction Contract Procedures (not according to VOB). But there might be other opinions.

A "specialist lawyer for construction law" advises competently before signing the contract, which generally costs about 300 euros +/- 50%.

Besides the contract, one must also understand the underlying "construction and performance description" before signing. Here, among others, the Association of Private Builders or various more or less qualified construction experts, construction supervisors, architects, etc. advise.

We also had our contract for €250 reviewed by a specialized lawyer, although the lady is a lawyer, but works in a different field. The tips were very helpful and several suggestions could be easily incorporated into the contract.
