Hello,
Interesting approach .... the staff at the building planning office will surely be happy to hear that.
It says "buildingANBAUTEN" as well as deviating roofBESTÄNDE of other roof pitches. If there is "only" an existing property that shows these exceptions, this does not mean in advance that you are allowed to do so, especially since the statute was amended in 2012; there must be reasons for that. Perhaps even the neighbor is the cause, as he disregarded the development plan and instead paid a fine
Arrange an appointment with the person in charge for you and avoid statements like "my wife and I want to enforce". Present your case and see what is possible. There are only human beings working in the building planning office as well and if you treat them kindly, they are mostly helpful ... within their means.
Best regards from the Rhineland
My wife and I have bought a plot of land and are trying to enforce a building permit according to our ideas.

The statute says:
"By way of exception, in the case of building extensions and already deviating roof structures, other roof pitches and roof shapes are permitted.
As a layperson, I understand this as: if there is already a house with a roof pitch of 38° in the building zone, then this is also permitted, right?"
