Hello,

in our property developer contract it states ".....access to the construction site until takeover....only permitted with the express consent of the seller".
Is the property developer allowed to refuse me this consent, for example if I want to take measurements (e.g. to choose furnishings) or if I want to check whether the installment he sent me by invoice has been fulfilled?
And am I allowed to bring a construction expert with me for this inspection (trade he charged) to check this for me?

Hello Gerda,

That means exactly what is formulated. If you want to enter the construction site – the developer has the house rights – you need his consent if you want to enter the construction site; whether alone or accompanied.

This is not always premature bad intention – there are quite a few builders who cause more damage – verbally and non-verbally – than the contractor – here the developer – can tolerate. I have experienced that builders, in their zeal to tidy up, have cut some things that they mistakenly thought were trash :mad: Of course, there is also the other side of the coin...

So you have to renegotiate with your developer – you have already signed the contract – about significant dates for inspection of the building by an expert. Not just verbally, but fixed in writing!
