Botch, house was not built according to plan!

Hello dear forum members,

my house construction is a long story, I will try to keep it short.

I live in Sweden and had a prefabricated house/wooden house sent from Germany. I discussed everything with the construction manager, sent him the drawings, etc.
When he built the house, a knee wall of one meter was missing. I was shocked; he told me that he had increased the pitch angle to 45 degrees and that I still had enough space in the upper floor. According to the contract, the house was supposed to be covered with clay tiles, but metal sheets were installed instead. His answer: it is much better, especially against storm damage.

The floor springs incredibly, it is not possible to lay parquet or tiles, and many other defects.

I was so stupid and paid the final invoice; does that also mean that the payment was simultaneously an acceptance?

What should I do now? I think I can forget about the knee wall and the roof covering with clay tiles, since I did not stop the construction, right?

I never received any plans from my construction manager.

Yes.


Due to your behavior – accepting every "correction" from the builder insurance – you have to accept partial fault; so in my opinion there will not be any significant damages.

However, that does not mean that your builder insurance – by virtue of the concluded contract for work and based on the bill of quantities – does not have to deliver the owed service; corrected according to the orally agreed changes to the construction execution. Since you are in Sweden and the builder insurance lives in Germany, you will not be able to avoid legal assistance. If I remember correctly, German law should apply in such a case.

Find a lawyer in Germany – preferably near the builder insurance’s location for convenience and costs – and explain to him your construction process, the defects. Furthermore, nobody here can give you advice, as legal advice in Germany is exclusively reserved for consulting professions :)
