Border-adjacent construction closed building style - windows of neighboring buildings

Hello everyone,

I have the opportunity to purchase the property shown in green in the attachment in NRW. The property is located in an area without a development plan; the surrounding buildings consist exclusively of block perimeter development. To the north of the property there is a three-story apartment building; at the red-marked point on the gable side there is one window per floor. Each window is the living room window of the apartments, but the rooms are also additionally lit from the west.

How would a contiguous building behave in this case, which would inevitably lead to the closure of the neighbor’s house windows? Is this permitted without the neighbor’s consent? Would compensation be due? Or must the owner expect that sooner or later the block gap and thus the windows will be closed?

I would be very grateful for assessments or information on the legal situation!

Why should a border construction be permissible? :eek: Something like that is out of the question! . How do you come up with the idea that you can simply destroy windows with your house? … this is not legal advice, but common sense. Just google border distance! And then go to your building authority. They will help you. There is practically no information here about what is legally permitted here. And apparently you don’t have the knowledge yet either ;)

There may be easements on the property? Or contractual agreements regarding the windows? Based on your picture and your sparse information, nothing of value can be said.

Fortunately, I never claimed that ;). As I said, buildability here is basically determined by § 34 of the Building Code, and in my opinion the missing boundary distance results from § 22 para. 3 of the Land Use Ordinance. The question is rather whether the windows in the gable side of the neighboring house "require a deviation" (regarding the boundary distance). But that, in turn, does not seem particularly logical to me, because the person who equips his gable wall with windows in a block perimeter development would massively restrict the neighboring property's usage possibilities if this would effectively prevent the development of the neighboring plot. Thanks for the hint about the building encumbrances! I will check that. Also, here is a larger excerpt.

Could it be that the plot here was not colored green by you, but in the official plan?, and that you might not be allowed to build on it because it must serve as a compensation area for the plot with the "red" house due to its floor area ratio exceeding the limit?
