Base sealing floor slab front side - position of the sealing?

Hello everyone, (I know that the forum cannot provide legally binding advice)

our house is standing. Phew. An expert came and criticized the base insulation of the floor slab (executed as shown in the photo in red and orange) - this violates DIN XYZ (13967?), the base insulation must run along the green line (directly on the floor slab). However, he could not clarify whether we are in a gray area and it is still okay or if it is definitely not allowed. The house builder says: even with our approach, no rising stagnant water reaches the wooden house - and furthermore, it is much cleaner and more practical to implement.

Now my question: where must the base insulation be installed in a timber frame house (or any other house): in front of or behind the insulation?
Will we get into trouble with this at some point?

What kind of ideas some people come up with – of course, the base waterproofing belongs behind the insulation. Just do it simply: the builder should name the manufacturer & product for the base waterproofing system for you, and show you a base detail/construction drawing from the manufacturer where their execution is depicted.

I agree with . The insulation belongs on the base plate or in front of the base plate, and then the insulation is applied before that. However, it is often found, mostly only in the area of window sealing, that this is led onto the insulation at the front (if it is already there when the windows are installed). In the base area, only suitable non-capillary active insulation material is used anyway, so the insulation can be behind it. As you have described it, the sealing can be damaged or over the decades be damaged by growth and movements of the stones or similar, and water can penetrate. How bad this is, the expert knows better, I only know that it should be done differently.

And then the sealing in the base or basement area must also be double (?) and of course fully adhered over the entire surface. The torch is probably often only applied spotwise there. If it breaks at one point, water can run behind the insulation; with full-surface adhesion, that can't happen.

But... Why do you pay an expert if they can't say whether it's serious and needs to be redone or not? They can't just say, "It's not professionally done, but whether it really needs to be redone, I don't know." !?! They present themselves as experts...

What has become of this topic? We have exactly the same situation. The foundation was carried out as a WU slab, the horizontal barrier exists. However, a vertical barrier does not exist so far and is supposed to be applied from the outside onto the insulation of the slab and then extended upwards. The expert says that this is highly unusual and, to his knowledge, not permitted. For about 3 months now, we have been waiting for documents regarding the technical building approval, which the construction manager and house building company still owe us.
