Attic problem no building permit

Hello everyone,

we have the following problem: we want to sell our childhood home and had finally found a buyer. Now the bank is throwing a wrench in the works and claims that the attic does not have a building permit for conversion. This surprises us a lot, as the attic has always looked like this and my parents also built the aforementioned house. The attic was built this way and, according to my parents, was approved as such. Now, according to the bank's claim, no records or documents exist about this. We are now really quite helpless and clueless and don’t know what to do anymore. We know that our parents never did anything under the table, and now we are confronted with such nonsense. We would be very, very grateful for any tips and help.

Well, if your parents built the house, then they should be able to show a building permit. It usually states everything that is allowed and not allowed.

P.S. Very unusual for a bank to actually check the building documents for a private construction loan in an existing financing. Normally, the data (property, cubic meters, square meters) is quickly entered into the system. Nobody recalculates whether the living area or volume is correct or how the interior construction exactly looks. If they check that intensively, the margin is already spent before any payout has been made. Are you sure the buyers are not using their bank as a front to lower the price?

I don't think so, because the bank told the real estate agent and she then told the buyer, and he didn't want the house anymore!

When was the roof expanded? Or do I understand you correctly that the house was built directly with an expanded roof? Then there must be a building permit and also the building plans, it can't be 200 years ago. By the way, with us, a roof expansion requires approval only under certain circumstances (we bought a house with a subsequently expanded attic, which was not separately approved, but complies with the regulations, so everything is fine).

The bank's argument could be that the attic is legally usable space, not living space, perhaps because - formally - the required heights according to the living space ordinance are not met or (accessible) escape routes are missing. The attic can be perfectly converted and very cozy, but on paper some criterion might be missing.

The classification is stated in the construction drawings for the building application, e.g. "No living space."
