Additional costs after the conclusion of the construction contract

Dear fellow builders and legally knowledgeable people, in October we signed a construction contract in which all our special requests, such as a fireplace, different room sizes, etc., were submitted by us in a so-called planning request. We then signed the contract with considerable additional costs. Now, even before the building permit is issued, the company wants a commitment from us that we will pay additional costs for tile work. However, the company knew about our wish to build larger bathrooms and now wants to refer to their original base price in a promotional house. Is it correct for the company to do so? The larger bathroom was not explicitly included in the construction contract, only the rough listing of the higher items. But they knew our planning draft, as they calculated all other additional costs based on it. Can someone give advice? Thanks to you all

What is not stated in the contract is not purchased. It’s as simple as that.

Is this "planning request" to be understood as an annex to the construction contract, thus actually becoming part of the construction contract?


Wishes and contracts are usually two different things!

Based on this sparse information, no one here can give a reliable answer. I myself do not know what exactly is now part of your construction contract and what the "planning request" is based on. As a rule: what is not recorded in writing in the construction contract is considered not purchased by the court.

Aside from the fact that I find the auction house thing a bit dubious (I wouldn’t have built with them, it’s even more dubious if the company refers to some original base prices in an auction. ALARM BELLS ARE RINGING ALREADY)

Wishes and talks and “they knew about it” (bet no one remembers?) are simply irrelevant. You get what is explicitly listed in the construction contract along with the construction description explicitly. Any deviation or change now costs extra. What exactly does it say about the topic of bathrooms? And what exactly does the company now want to charge separately?

From such contracts I actually only know it in such a rough form:

“Bathroom, tiled floor covering according to sample QM price max. xx Euro, size 30*30cm, diagonal installation costs extra, larger tile formats cost extra… walls tiled up to door height according to sample, tile price max. xx Euro…”

I have yet to read exactly that 9.37 sqm of floor tiles are laid in the bathroom anywhere.
