Additional construction costs - fully developed plot

Good morning!

We are about to acquire a plot of land. It is newly developed building land directly from the municipality. The plots are fully developed, all utilities are available directly on the property and have been freshly installed.

Yesterday, we learned from other prospective buyers in the area that, in addition to the purchase costs, there is also a "road fee" due ....apparently, this is paid because the building area was developed with new roads.

Can someone tell me how this is calculated and whether this is even legal if you purchase the plot as fully developed? What else should we watch out for? I am afraid that the whole thing will end up costing more and possibly also involve some initial connection costs for the utilities laid on the property that could be passed on to us.

Fully developed meant to me until now that I am exempt from any costs previously incurred for the development.

Your city / municipality can inform you about this. They built the Habens and can usually break down all the costs for you. Also what has been covered by which payments.

Fully developed means that you can start building right away.
Fully developed does not, however, mean conversely that all development costs have already been charged. According to the state building regulations, the costs of initial development can be allocated to the landowners.
That means you pay for the sewer, the roads, the compensation areas, the lamps, etc.
Depending on when the development took place, the respective owner pays the costs. If the development fees have already been allocated, then the municipality had to pay (but this will certainly have been factored into the land price). If only the road is still outstanding, then you as the new owner pay the development fees for the road, …
Rough guideline in Bavaria: We pay just under €100 per sqm in development fees. In the neighboring village (slight slope), it was already about €180 per sqm fees.

100 € development fees??? That would double the land price here....

Does the purchase contract have to specify which costs are already covered and which still apply, or do I only get such information upon request?

They should be stated in the purchase contract. If only because of the real estate transfer tax. However, one should still ask which costs are yet to come. The costs depend on many factors anyway.

Plot size, street costs, and size, etc. For us, it was just under €60/sqm of land. 500 meters further only €50. But the city administration could tell me exactly how much everything costs. So sewer, street, compensation, and so on. That then results in the total amount.

I don't think that the price per sqm/development depends on the land. It depends on the costs incurred in the development of the municipality. If a small street is created quite outside a town center (e.g., in a cleared forest), more costs are incurred than if a new development area is expanded. Also, it depends on the "equipment" of the area/street: paving with developed sidewalks, fancy street lamps, and a tree every 10 meters between parking spaces is certainly more expensive than an asphalted path without a sidewalk with undeveloped shoulders as standing areas.



Of course, you communicate with the municipality. If you are interested in a property, you should officially receive documents with all information and hold discussions with the participants. All questions should then be answered before going to the notary you trust.

But don't forget that you are responsible for your own utilities. Fully developed means that all lines are at the property, but connection costs for gas, water, and electricity (possibly also telecom) must definitely be paid by you yourself - about 8,500 euros. Many don't consider that. These costs arise after the application and execution by the individual providers.

... and don't forget the sewage connection...
