Acquisition of property from the municipality - parts with sidewalk

Hello everyone,

We are about to purchase the plots:
12/5, 11/4 as well as 11/3

We are acquiring the first two plots from a private individual and will then merge them.
We now also have the opportunity to purchase 11/3 from the municipality. You can see in the graphic (red outline) that there is a sidewalk + part of the street in the lower part (paved).

How can I deal with this? Am I allowed to tear it down? What rights or obligations might I have?

A look into the land register works wonders.
If a [Grunddienstbarkeit] is recorded, it gets complicated.

Make sure to get informed about it – also regarding how it looks concerning [Winterdienst]. A few years ago, my parents-in-law had the issue that the city bought part of their property to build a sidewalk there. And it was casually mentioned that my parents-in-law would have to perform the [Winterdienst]. But after a complaint, that was removed.

Thank you very much for your responses. I have now received the number of the responsible lady of the VG from the mayor. Unfortunately, she will only be back on Monday. I will report!

This is, for example, one of the problems: winter road clearance service, then there might also be easements and right of way. If the street or sidewalk runs over it: lease or restoration by the VG?


If you don’t absolutely need it (setback area, floor area ratio/building coverage ratio), I would tend to advise against acquiring the plot.

I would ask the municipality directly.
