Good day,
we are currently planning our house with our developer, but he cannot even tell us whether and what we are allowed to build according to the development plan and the state building code of SH. The developer believes that we have to add a bay window (at an additional cost of over €15,000). Apart from the fact that we don’t want that at all.
Our wish is a single-family house with a higher knee wall (over 1.50 m so that we can still install ribbon windows). We do not care whether it is a gable roof or a hip roof.
Development plan:
Roof pitch: 20-48°
Eaves height: 5 m
Ridge height: 9.5 m
We understand the state building code to mean that we have to ensure that no more than 3/4 of the ground area of the ground floor has a height of over 2.30 m. According to our design, the guidelines should be met, right?
"""
According to § 2 Abs. 8 of the Schleswig-Holstein state building code, full storeys are above-ground storeys if they have a height of at least 2.30 m over at least three quarters of their ground area. The converted attic storey may therefore not cover more than three quarters of the ground area on the ground floor.
Further details can be found in the attached legal text.
“(8) Full storeys are above-ground storeys if they have a height of at least 2.30 m over at least three quarters of their ground area. A top storey set back from at least one external wall of the building or a storey with at least one inclined roof surface is a full storey if it has a height of at least 2.30 m over at least three quarters of the ground area of the storey below; the height of the storeys is measured from the upper edge of the floor to the upper edge of the floor of the storey above, or for storeys with roof surfaces, to the upper edge of the roof covering.”"""
Could someone please help us here to determine whether our design complies with the guidelines? Or if we really do have to add a bay window?
