Wood-look tiles grouted with the wrong color - redo completely?

Hello everyone,

in our new apartment, we had wood-look tiles installed throughout the living area except for the bathroom, with 2mm grout width.
Already when ordering the tiles through the developer, we selected and fixed a matching grout color in writing. A nice brown tone exactly like the tiles.
Despite further coordination with the supervisor of the tiling company, the gray grout color that we chose for the bathroom was used throughout the entire apartment.
The mistake was admitted in writing yesterday, with the note that nothing can be done about it now.
I am absolutely not satisfied with the color and would most like to have everything redone completely.

Do I have the right to do so at this point?

Can only recommend a good specialist lawyer for this.

Report defects in writing and request rectification with a deadline. If not fulfilled, set a grace period and then

refuse acceptance.
withhold payment.

Alternatively, replace the contractor if the defect is not rectified.

If it is such a specifically required feature, then I see good chances.

Hopefully, it is a company that is not immediately insolvent.

Ow - difficult.

Ok, you have it in writing - but with 2 mm wide joints and a judge sympathetic to the craft, I would be cautious about a self-initiated substitute first name. That can backfire.

Brown Eding? (Joke...)

Hi,
yeah, it could get interesting. You have it agreed in writing and they messed it up. Basically a sure thing, but it can happen that a judge considers the effort to fix the defect disproportionate. It is purely a visual defect (you don’t like the color) and not a technical defect (all joints uneven, poorly filled or leaky).
No idea if you can scrape out 2 mm wide joints and re-grout them. If not, it would mean having to remove all the tiles and redo everything. I would be rather surprised if you can enforce that.

Find a good lawyer, you will need one. I think it will end up as a reduction in payment.

Under no circumstances pay any invoice!

Best regards,
Andreas

If the contractor invokes unreasonableness, here is a quote from the internet.

NEGLIGENT CAUSATION OF THE DEFECT - DEFECT REMOVAL NOT DISPROPORTIONATE
OLG FRANKFURT, JUDGMENT OF 12.07.2013 - 24 U 143/12
Even if the effort required to apply the owed thermal insulation is considerable for the contractor, the client nevertheless has a claim to the creation of the owed work. That this involves considerable additional effort is solely the contractor’s responsibility, provided he has used grossly negligent incorrect thermal insulation panels.
