Winter garden outside the building window?

Hello, how difficult do you think it is to get a conservatory approved outside the building line (location Saarland)? The boundary distances to the neighbors remain unaffected. It is only to be built towards the garden.

Extension on an old building for maximizing living space or new construction? The difficulty depends on the building authority, therefore it cannot be assessed by us. Nevertheless, the argument of optimizing living space in the old building can more likely trigger a positive response from the building authority.

Hello, new building, two-story. But building window probably too small for conservatory.

With a conservatory, I do see some chances. It depends on how old / new the development plan is – how fixed the opinions on this are, etc. In general, conservatories / bay windows / balconies are sometimes approved even outside the building area. Just submit a building pre-application and you will know (then bindingly) or you call the building authority, make an appointment and ask the ladies / gentlemen how they see it.

Hello Passive House,

go to the building authority and ask whether the defect can be remedied by a waiver of building obligations and/or neighbor approval. Alternatively, you can ask an architect/surveyor who is authorized to create the relevant plans in Saarland.

Basically, the situation should be such that you still have space within the building envelope, on which you relinquish outside for the benefit of the conservatory. Hence the name waiver of building obligations.

In NRW, I could give you a reliable answer, but in Saarland the regulations may differ, so ask an architect, surveyor and/or building authority. You can save yourself a paid construction preliminary inquiry. If a building application is required for the conservatory, you will need an architect anyway.

What is stated in the textual stipulations of the development plan? Often there are stipulations that a conservatory (the type of construction is often specified) or dormer windows may exceed the building window by "x" meters. If not, Dirk has described the correct approach.
