Tree over sewer line / clearance distance to public road

Hi everyone,

we have a distance of 3m between our house and the street. We would like to plant a ball maple, but I currently have 2 problems:
- at the spot where we want to plant it, there is a sewage pipe running at a depth of about 100-110cm. That should actually be enough for the root depth of the ball maple. Does it still make sense to lay foil around the pipe to prevent rooting on the pipes? Or is it currently quite a crazy idea because sooner or later the tree might have to be removed anyway for pipe maintenance?

- Since we naturally want to plant the tree in the middle, it would therefore be about 1.50m away from the public street. The following is stated in the Saxon Neighbor Law:

§ 9
Distance limits for trees and shrubs

(1) The neighbor can require the owner that trees, shrubs or hedges within a continuously built-up area must be at least 0.5 m or, if they are over 2 m high, at least 2 m away from the neighbor's property boundary.

§ 12
Exceptions

Sections 9 to 11 do not apply to

1. Plantings on boundaries to areas designated for common use, 2. Plantings in public street areas and on riverbanks, 3. Plantings behind a wall or an opaque fence, provided they do not exceed it.

But what applies now? How much distance do I have to keep from the street?

Distance rules always apply to the neighbor - I have already searched for NRW on how it is with trees towards the municipal street and haven't found anything yet.

And I would NEVER plant a tree directly over a line... at least 2m beside it, even then it roots up to it.
Assume that a tree always grows as large and wide as its crown.

These are regularly the publicly dedicated streets. Such is the case with your street in front of the door. Even if it is not yet dedicated, it is probably only a matter of time. The development plan can help further here; the public traffic areas are usually shown in yellow there. These should then actually also be dedicated.

We had a company for [Kanalinspektion] here some time ago. The employee told me that roots are no problem for the sewage. However, I no longer know if that is always the case or if it only referred to our repaired sewer.

In the easement for the right of way, it is sometimes also stipulated that nothing may be planted over the line. I would definitely check that just to be safe.
