Temporarily remove boundary stone

Hello,

my neighbor is currently making his strip foundation for his prefabricated garage, which is supposed to stand directly on the property boundary. In order to dig nicely, he removed the boundary stone and marked the original position with string supports.

Is he even allowed to do that? I always thought the boundary stone is "untouchable." Only the cadastral office or commissioned surveyors are allowed to handle it.

Hello,

the removal and placement of boundary markers, including boundary stones, by unauthorized persons or companies is an administrative offense. No neighbor and no construction company is authorized to do this, not even a surveying office for engineering surveying. These tasks may only be carried out by a publicly appointed surveyor.
