short-term notary appointment - possible pitfalls

Dear florists,

I am about to buy a condo. I have a good financing offer and will commission the broker on Monday or Tuesday to apply for the loan with the bank on my behalf.

Actually, the seller had suggested a notary appointment on September 5th or 6th; that would actually suit me well, as it would give me time to finalize everything with the financing, etc. However, the broker just wrote to me that a date as early as next Wednesday is also possible. After that, the seller will be on vacation until early September. The appointment in early September would probably still be possible. On the other hand, the broker said he would recommend the earliest possible closing to be on the safe side (of course, he wants to have his commission in his account soon).

On the other hand, that would not be entirely inconvenient for me; that way I could be sure that I definitely have the apartment and the broker does not come up with another buyer in the meantime who pays more.

I see two possible problems: For the registration of the mortgage, I need the relevant documents from the bank, let's see if I can get them on such short notice. If these only arrive at the notary later, I would have to pay for a second notary appointment for the registration of the mortgage, right?

In addition, I have not yet seen the purchase contract. According to the broker, it should reach me on Monday or Tuesday (the notary was arranged by the broker). I am not completely inexperienced legally and my cousin works in a law firm that also deals with the collection of real estate loans; maybe she could take a look, but I want to avoid receiving a 20-page purchase contract just one day before signing.

What do you think? And: am I overlooking any other possible problems?

If you are sure that you will get a loan, I would keep the appointment. There is a separate fee for the mortgage anyway. On the other hand, the risk for another buyer should not be that high if the seller is on vacation, the agent also knows that you want the apartment and may not want to create extra work to find another buyer with a higher budget.

I don't like it. You pay the notary and you choose. This rushed thing, why not early September? Calm. Keep calm. You name the law firm and possible dates. The broker should now keep his feet still. You will pay him, right? Then also tell him that for your money he should kindly consider your interests. There should be 14 days between the draft contract and the appointment. If the seller is a company, then this is even the law. Karsten

I would always want to choose the notary myself as the buyer.

Although the agent always has a good direct connection to a notary (he has his network) and thus quick appointments, you should still use the right to choose your own. It then feels better. You can also deviate from the 14 days then.

Thank you for your comments. I will sleep on it again. It seemed quite practical to use the notary suggested by the broker, since I don’t personally know any notaries and wouldn’t know according to which criteria I should choose one. But that you might expect more neutrality, of course, is true. However, I’m realizing right now that it stresses me a bit to have the whole thing still up in the air. In that respect, I’m not at all averse to signing as soon as possible...
