Shell construction according to the Building Code or VOB?

Hello.

You can find all sorts of information on the internet about this topic - however, things often change over the years.
How is the beach today, what is recommended?

Which contract templates are recommended?
For the Baugesetzbuch I have the one from ZDB, for VOB from Kohlhammer.

Thanks for your experiences.

Warranty law according to the Building Code applies to a wide range of products, VOB is more construction-specific. But: be careful with the warranty periods, as I understand it, the Building Code offers 5 years whereas VOB only 2 years. In principle, it would be possible, although there are probably hardly any templates for standard contracts, to mix both variants (e.g. different for foundation and roofing). This would then, of course, be a case for a (preferably specialist) lawyer, but it pays off in case of warranty claims. Hopefully, the site supervision is not to be performed by yourself?

No, construction management is not done by us. The site manager suggests VOB. Warranty can also be fixed for 5 years here.

I (however, am not a lawyer) know of no problem with the VOB except in the case of possibly shorter warranty periods. If one considers and resolves the latter, the alternative is clear to me: as mentioned, the VOB is clearly more specific, whereas the Construction Code is supposed to "fit" everything Lieschen Müller could ever buy or commission.

Construction managers also usually have more "practice" with the VOB: besides warranty periods, procedures can differ as to when and how defects must be effectively reported, and so on, or when a service has been "accepted" at all.
