Request for knee height increase +20cm

Hello everyone,

we have a knee wall of 80cm in the BP. Since every centimeter counts, we would like to try to increase this to 1m. What is the best way to do this? Can an application be submitted before submitting the building application? Or should one simply submit the building application with a knee wall of 1m and hope that it gets approved? I have already heard several times that +20cm is approved in most cases.

By whom exactly heard? If you want to deviate from the development plan, a complete building application is required, which will then be approved or not.

To my recollection, we applied for and also received approval for an increase of about 14 cm in the total wall height with an isolated exemption from the development plan. However, it was a tough piece of work for our architect! And our "advantage" was surely also that the development plan is around 30 years old and the newer development plan just one street away already generally allows 30 cm wall height.

With a current development plan specifying the knee wall height, I personally would hardly have any hopes, but you can only really find out by trying.

Assuming I try, will the plan simply be rejected and I have to submit a development plan again (which can already take months to be processed), or will it be noted on the knee wall that it may only be 80 not 100 cm high, and then the development plan will be approved?

So I just don’t want to waste time unnecessarily with multiple iterations.

So "Bebauungsplan" always means "Bebauungsplan" here in the forum, you probably mean the drawings for the building application, or building notification, if there is a Bebauungsplan in your area.

It is probably a bit different everywhere. If the people at the office are nice (for example, where we are), they call you and say, "this and that doesn't work, you need this and that." Then you submit it afterward and the application is further processed. If they are overloaded, then it's a quick decision and that's that.
Is there someone in the neighborhood who has the meter? Then ask them.
