Hello,
does anyone have experience with the above topic?
The following: if a tenant takes out such a guarantee for two cold monthly rents with their bank and then does not pay rent for one month, can the landlord then only claim one cold rent, or can they demand the full warm rent?
This is certainly only possible up to that amount, meaning that at the latest in the second month of rent arrears the landlord can only claim the sum up to the final amount?
So two cold monthly rents amount to a total of 1000€, one warm monthly rent amounts to 600€, now only 400€ remain in the next month!
If the tenant then repays the amount deducted from their account to the bank, does the landlord then have the full amount available again if something is wrong?
