Rental Agreement - What needs urgent attention?

So, now I finally have my new apartment! I will still receive the lease contract by mail. My question now is what there is to consider in this lease contract. Are there any points or clauses in these contracts that must be included - or that must not be included! Or any pitfalls that I as a greenhorn might overlook? Thank you all Sibi

It is not that simple to say, the individual contract must be looked at closely, the BGH has struck down some formulations regarding [Schönheitsreparaturen], but certainly not all are affected. The devil is in the details here as well.

Yes, I will probably have to wait a moment until I receive the contract and can then read everything through.

Termination options

You shouldn’t be surprised by the listed termination options. :rolleyes: Otherwise, as mentioned, just wait until the contract arrives and then clarify the things that you don’t understand or that seem suspicious to you.

Normally, administrations do have an official standard rental agreement (e.g. "Zürcher Mietvertrag" etc.), possibly even from the [Mieterinnen und Mieterverband]. You can then also assume that it does not contain any pitfalls. Furthermore, the rental contract law for apartments is quite extensive...

Read everything very carefully and preferably twice. If you overlook anything that is required, you could have problems later. For example, some contracts regulate [Wäschetrocknen].
