Hello,
we are planning to build a single-family house and are already quite advanced in our planning. The construction financing is also in progress. However, a crucial question has arisen.
In the land register, section II, a priority notice of conveyance for the state of Berlin is registered. This results from the purchase under the "Modrow Law," according to which the property must first be offered to the state of Berlin for purchase at a price of 1 DM per m² within the next 30 years (from the purchase date - 1995).
Now the bank is telling me that there is a condition regarding a subordination of the priority notice of conveyance.
1. What does this mean?
2. Who files such a subordination and to whom do we have to turn? Who is responsible for this concerning the state of Berlin (the purchase contract states: District Office ... Department of Economy and Finance, Land Registry Office - but this department no longer exists)?
3. Can the financing still fail because of this?
