Pay property acquisition tax on house and land?

Hello everyone,

we are planning to build and have received the first cost estimate from the developer. The plot of land is included in this. It costs 67,000 euros and we are supposed to pay about 15,000 euros in property transfer tax and notary fees. We have 5.5% in our state, so I would come to at most about 3,500 and maybe another 2,000 for the notary. Now I asked about this and they said I have to pay property transfer tax on both the house and the land, is that correct? I am only buying the land and then building the house myself with the developer, I am the builder after all and not buying a finished house. What do you think about this? What could I do or do I have no choice but to look for another developer? Of course, then the land would be gone too.

Hey,

if the house is built with the land seller or an affiliated company, then the real estate transfer tax must be paid on the total amount, even if both are regulated in two different contracts. The tax office assumes a joint application. So if you buy the land from the construction company, you will always have this "problem." And if you buy/build separately, most tax offices now seem to ask anyway, and it depends and is examined – opinions currently seem to differ somewhat as to when the tax must be paid on everything and when not.

Well, there is definitely a catch with these gag contracts.... be glad they answered you honestly.... there are plenty of people who are paying the price now :) And the tax office is anything but lenient here :)
