New construction on garden property, building permit not yet available and property is currently located in HQ100. However, there are comparable building permits in the neighboring municipality. The question is whether it is even possible to obtain a building permit here in Bavaria. Who can say something about this? Would be grateful for experience reports or information on the procedure to realize the new construction.

Perhaps as an addition, The garden plot was not yet affected in the HQ map from 2009. On the 2019 map, however, it was now marked. I am thinking of submitting a preliminary building inquiry with corresponding measures, such as raising the house on stilts or higher.

Plot already purchased or "existing stock"?

My knowledge is 30 years old and applied to NRW (I was back then in the lower water authority of the district Coesfeld :cool , presumably the rules have not been relaxed: Building in HQ100 is basically prohibited according to §xx (I believe 34) WHG! Exception permits are associated with many (expensive) requirements and lengthy approval procedures.

Hello, thank you for the reply. No, it has not been purchased yet. As far as I know, the current owners have not dealt with it. I will take a look at the paragraph and will contact the municipality. It was important for us to know if someone already has experience and can describe the procedure up to the building permit application.

Well, the authorities care relatively little about the protection of your building. It’s about the common good, meaning the obstruction of drainage during a "one hundred-year flood event."

If a house stands there, the water drains worse or is "unfavorably" diverted. That’s generally the issue. That means measures would be compensatory measures so that the corresponding amount of water can flow into depressions. Those are rather not feasible on your plot size.

I have no practical experience. I would rather be reluctant to build in an HQ100 area.

But presumably it will be examined separately in any case. And if it’s a nice, buildable plot and even affordable, why not.

Contractually, I would always reserve the right to withdraw (undo the transaction) if the building permit is not granted. Just having a deck chair on the plot doesn’t make you happier either.
