Again me, somehow our construction project does not seem to be under a lucky star ...

Today the BU told me that the city requires the neighbor's consent - to be precise, we need an official site plan with a cadastral excerpt.
To be honest, I wonder why?
When can an authority demand this? We do not violate any setback areas on other properties, but want to use a piece of public land. Why could the neighbor's consent be necessary?

I only know that this will also incur higher fees ....

Sometimes I really wonder if the fingers are faster than the mind when writing.

There are people who pay €500 per square meter to accommodate their setback areas on their own property. You are only using public spaces. The general public is therefore bearing this area cost for you.

Is it then too much to ask to pay three fifty for an official cadastral plan? Should the neighbor, in this case the city, also obtain the documents for you and preferably enter the areas right away - because the architect was also saved on....

It is precisely because of such people that the fees become due.

no, that was not meant like that. I am just wondering to what extent all the effort is worth it, we want to exceed exactly 48 cm over a length of 2.71 m, half of that we need, so 24 cm from the sidewalk, as a distance area.

We are not yet the owners of the property, which means I do not simply get the site plan and it is not about these fees for me here. I am concerned about the neighbor's approval and that according to the city, this approval involves extra effort and therefore a fee of + 350 euros.

I just want to know why neighbor approval is necessary here.

By the way, we live in a Bavarian big city, we would like a little more ground, unfortunately it does not exist, even though it costs 420 €/sqm here.
