Land register burden / imposition of a wetland compensation house construction

Hello everyone. After some searching, we recently found a very nicely located and fully developed building plot. However, upon inquiry, the private seller informed me that there is a land register burden. Apparently, when the property was converted from its original green space into building land, the authorities imposed the condition that, in exchange for building a house, a wetland of the same size must be created. Given the overall size, the property certainly allows for such a use, and a large, natural garden area was planned anyway. The seller will also take care of carrying out the work in this context. Nevertheless, the question now arises as to what one should think of such a condition. Are such provisions standardized in any way, e.g., regarding their design? Or does it simply depend on the wording of the condition? I would be very grateful for a few useful tips. Best regards Lars

As a rule, the exact execution is specified in the development plan or the associated regulations. If this is not the case for you – perhaps due to new construction in the § 34 area – contact the responsible building supervisory authority; possibly also the lower water authority. There you will receive very precise information on the execution of the compensatory measure.

Hello,
I can't tell you anything about the construction. Purely from a financing perspective, you should inform the bank about the prior encumbrance. Some have a problem with that, some don't. As a rule, it should not be a problem.
