Land division - Real and ideal division?

Hello, we have found a house and are currently just about to sign the preliminary contract with the notary.

The plan was a real division of the property. It is a semi-detached house with separate house connections and heating.

Now the property has been remeasured and it was said that due to building regulations (fire protection), a real division would not be possible.

I would now like to know if we have a devaluation in case of an (ideal) division by the notary?

Are there important points to watch out for? I am very grateful for any experiences and tips.

Who initiated this? For what purpose? Who carried out the survey (architect, publicly appointed surveyor, ...)?

There are various possibilities. One could upgrade the fire protection. Whether this is worthwhile and who would pay for it would of course need to be clarified. One could register a unification building encumbrance. This would limit the connection with the neighbor to building law issues. But even a detailed declaration of division according to WEG offers many regulatory options that come very close to a real division.

Hard to say, since with WEG the gut feeling always plays a role. There are people for whom this is never an option. As long as you or your semi-detached house partner do not plan any changes requiring a building permit, there is no difference in everyday life between a real or ideal division. Nevertheless, a later sale might be more difficult – it entirely depends on the prevailing market situation at that time.

I have not had direct contact with the surveyor yet, I only read the email correspondence through the seller. Now they are first trying to get it approved through the building authority. I just wanted to inform myself now whether the [ideelle Teilung] would then be an option for us.

I have never noticed a difference between QM prices of real divided land or ideally divided land. There are practically no disadvantages.
