Land division by means of a building application with subsequent demolition

Hello dear building experts and builders,

we own a plot of land with an area of 1,300 sqm, which is built on with an old, small residential house in which we currently live. There is also an outbuilding on the property. We would like to divide the plot and build on one part a new single-family house for ourselves and on the other part a two-family house for rental purposes. However, the boundary line of the two new plots would run through the existing building (single-family house), which we currently occupy. We actually want to continue living here, partly to save costs and partly to be close to the construction site. An acquaintance told us that we can apply for the division as part of the building application for both houses and thus shorten the processing times at the authorities and also initially construct the new buildings and demolish the existing buildings after completion and moving, which would allow us to continue living here. The existing buildings do not stand in the way of the new buildings but must also be demolished to comply with the floor area ratio. This approach would be ideal for us! Since we have no experience/knowledge and unfortunately found nothing in online research or specifically here in the forum, I ask you for help here. From your point of view, is this procedure possible? Are there any special features for Brandenburg? Has anyone perhaps already done something like this and is there anything to consider?

If you find a surveyor who agrees to do that, it might be possible. In our case, it was about a garage that was also in the way of a new building. Whether a surveyor takes that risk with a single-family house, which theoretically could remain standing, I doubt...

Hello Tolentino, thank you for your quick response! What exactly is the risk for the surveyor? I am obligated to tear it down and would have to bear the consequences if I do not comply, right?

What does the building authority say? You have certainly spoken to them on the phone, right? Asking a friend first, then a layman forum, is certainly not the best idea (despite Easter ;))

I have actually not asked the building authority about this yet. I first wanted to get a "feeling" for the matter and also gather arguments... Contacting the building authority would then be the next step for me.

The building authority will merely inform you that no illegal situation may arise from the division, which would be the case with an existing house on both sides of the boundary. Obligation or not. The surveyor could anticipate facts, but ultimately he would be falsifying an official document, which is why I don't believe you'll find one who does that. But stranger things have happened. If you ask at the BA, you risk waking sleeping dogs...
