KFW40 - Obligation in the Development Plan

Hi,

the other day I was really happy to have found a new housing development that is currently being developed.
Now I read in the development plan that a KfW40 requirement exists and that this should be recorded in the land purchase contract.

I can hardly imagine that about 40 buyers can be found who are willing to do that.
That actually doesn’t really pay off yet, does it? For your information, there is no obligation to a developer in the area, so these are freely buildable plots.

Question: Can it really be handled so strictly in the development plan?
I can still imagine KFW70 or KFW55... but KFW40 seems quite severe to me....

Why not? Often much more is determined, such as the roof color or the architectural style, etc. I think it can also be specified which Kfw level must be built.

You don't have to buy it,... You can also sue against it!

I also find the KfW40 commitment intense – especially since significant additional costs arise, which pay off little in the medium term. But it is no longer uncommon for municipalities to deliberately create small passive house villages to appear environmentally conscious or innovative outwardly ;)

Intense or not - yes, the land registry office in consultation with the building planning office can issue these requirements. A lawsuit - formulated in any way - is unlikely to have much chance of success.

If you want to remember, the Renewable Energy Act was just amended and the new Energy Saving Ordinance is also close to final approval. The medium-term goal is to allow only passive houses from 2021 onwards; "your" new development area already provides the first glimpse of upcoming times.

I am convinced that it will find quite a few new builders; especially in times of land scarcity ;)
