Hello everyone,
we are in the preparation phase for building a semi-detached house (Bavaria). The plot has been newly separated (a building gap) and may be developed according to §34. There is a development plan for the area, among other things only gable roofs with about 45 degrees and a knee wall are allowed. We want to build a gable roof with 23 degrees without a knee wall - that is the only deviation from the neighboring houses. There are also at least 4 or 5 houses in the area of the development plan with flat gable roofs or urban villas - but not directly on our street, rather on the neighboring streets.
The questions are:
1. Is it generally necessary to apply for an isolated deviation from local building regulations if there is no development plan for the plot?
2. If yes, how can this deviation with the flatter gable roof without knee wall be justified? Are there experiences/tips for formulations?
3. Can one refer to similarly built houses, even if they are not built directly next door, but rather on the next street?
