Is the relocation of grounding done correctly?

Hello, I am currently building a new house and have a question. In the attic, all cables are nicely laid in empty conduits except one, an NYM-J 1x16 (grounding?) which is not in an empty conduit, but since screed will be poured there later, this is not correct, right?

There is nothing visible in the picture on which a statement could be based. In general, cables do not have to be in conduits. However, the permissible length, calculated depending on the diameter, is determined by the external boundary conditions.
