We have two fixed-rate mortgages with our bank, which we would like to terminate early.
Below is the response from our advisor regarding this:
Unfortunately, we have to inform you that an early termination of a concluded fixed-rate mortgage is only possible in the event of a sale of the owner-occupied home. In this case, the approximate costs for a termination as of 30.06.2010 would be as follows:
Fixed-rate mortgage EUR 140,000.00 with a term until 31.1.2016: compensation for interest difference of 2.36% over 2010 days -> compensation of EUR 18,447.00.
Fixed-rate mortgage EUR 110,000.00 with a term until 31.1.2012: compensation for interest difference of 2.95% over 570 days -> compensation of EUR 5,100.00
Now to my questions:
Is it legal to tie an early termination of the mortgage to the condition, as stated, that the owner-occupied home must be sold??
And is the amount of compensation quoted by the bank normal??
