Information in the development plan - is there an eaves height for the flat roof?

Hello everyone,

I am new to this forum and maybe you can answer a question for me.

I am about to buy a plot of land and our dream house consists of two full storeys and a small recessed top floor. Unfortunately, the development plan does not address the possibility of constructing a building with a non-full storey.

In this specific case, the question for me is which building heights should be applied for the construction of a flat-roofed building with an attached recessed top floor.

In the development plan, the definition of the eaves height of 6.5 m and the ridge height of 10.5 m unfortunately only refers to pitched roofs.

Since a flat-roofed building does not technically have an eaves height, my question is whether, for a building with a flat roof and a recessed top floor, only the ridge height and therefore the building height is relevant and the eaves height specification is disregarded?

In the case of flat roofs, the "wall height" usually replaces the eaves height - in my opinion, here depending on the setback of the recessed top floor, that of the full stories including the attic. However, the depicted single-pitched roof is explicitly excluded for you. It would be better if you also upload the usage template, and even better if you immediately specify the development plan (municipality, name, number - NOT as a link). Where is the "reference point" here anyway?

You just called out my name And you know wherever I am ... The correct term would be: no ridge height No. That is not surprising, since only pitched roofs are permitted. Buy another plot or say goodbye to your dream. If life were that easy... Actually, according to the principle of a ruling by the OVGMV, the eaves of the recessed top floor counts as the eaves height. However, since the ruling relates to a special case, it also opens up possibilities for interpretation in differently constituted cases. I do not see those here, since on the one hand only pitched roofs are permitted and single-sloped shed roofs are excluded.

That is absolutely correct! Shed roofs are excluded. The roof in my drawing of the recessed top floor was intended to represent more of a flat roof with a slight pitch for water drainage...

However, flat roofs are allowed (roofs <20°), but these must be greened or equipped with photovoltaics or solar thermal systems.

I just spoke again with the building authorities; apparently, in a final version of the development plan (which has not yet been fully adopted), further details—especially regarding buildings with flat roofs—are to be added. Apparently, I am not the only one who has been thrown off by this.
