Good day everyone,
I have a small problem with the offer text, namely, when a contractor makes me (a private person) an offer with the following information: "The work can be carried out after a 14-day lead time, at a total price of XXXX euros including labor, material as well as all preliminary and follow-up work."

Is this a gross or net price if it is not explicitly stated?

Are you clearly identifiable as a private person? Then I would say "gross".

Do you have that in writing?

Yes, I have it in writing. It is for my house which is currently being built, actually clearly identifiable as a private person. We are not entirely satisfied with the work and have complained about it; he has to make expensive corrections. Now the contractor claims that the price in the offer was supposedly meant as net and that 19% VAT would still be added.

Hello,

Invoices for the end consumer must _always_ be shown gross, that is including VAT.

More details can be found in the "Preisangabenverordnung".

According to the Price Indication Regulation towards end consumers, prices must always be stated as gross.
