House arrangement according to development plan/parking regulations

Good day dear forum,

I just came from the municipality because I wanted to find out from the friendly responsible lady what is possible in this area. Unfortunately, she couldn't really help me.
In the attached picture you can see our development area, my parking space is No. 44. As can be seen in the picture (blue line), I have to keep the house 5 meters away from the street. Here is question 1:
1.) Can this distance be reduced with a permit?

Furthermore, I would like to place the garage at the corner to the street, directly on the 2 borders, meaning one side to the street and one side to parking space No. 48 (border development, garage is 7x7m) and the gate facing upwards (so I do not block the street when I drive in).
2.) Is that allowed?

I do not see the arrangement as binding as depicted with the symbols; within the building envelope (blue lines), you will also be allowed to position your garage on the south boundary next to the neighbor’s. However, I do not see you exempt from having to set the garage back 5 m from the street, even with a northern garage door, in order to provide freely accessible visitor parking there.

I just saw that the building envelope is 3 meters away from the street. Am I now allowed to place the garage on the 3-meter boundary to the street or does the parking space rule with 5 meters apply? (Garagentor zur straße)

I clearly see the 5 meters applying here, it does not say "in front of the gate," but rather "between the garage and public traffic area." Here it is also not justified - as is sometimes even the case in state building regulations - by sight or driveway backup avoidance. Rather, it is probably intended to serve the purpose of guaranteeing freely accessible visitor parking spaces - which is why there are no chains, etc.

Why not? According to both the parking space ordinance and the development plan, you must adhere to the 5 meters. However, since both regulations concern the "parking of motor vehicles" and "additional parking areas," I consider a waiver very likely if the driveway is not oriented towards the street and the desired storage space is created. Since parking spaces and garages outside the developable areas in the development plan are not excluded and no visibility obstruction due to the street layout is to be assumed, I could also imagine that a street-side boundary development will be approved. However, the designer should write a few explanatory words for the reviewers when submitting the building application (possibly a preliminary building inquiry). What are you planning now? A semi-detached house with ideal division? Keep in mind that you need 1.5 parking spaces per residential unit that must be independent of each other, i.e., the third required parking space may not be located in the storage area. I interpret §2 of the textual provisions of the development plan The base and floor areas entered in the development plan drawing apply as maximum limits and must not be exceeded. to mean that the 50% excess allowed under §19, para. 4, sentence 2 is not permitted, so the floor area ratio will be quite tight.

Why do you want to block off the south side of the property with the garage?
