Hello, my girlfriend and I signed a construction contract in August. Unfortunately, for various reasons (loss of job, illness of the father) we can no longer build and would like to withdraw. Furthermore, the plot of land we wanted to use for the construction is no longer available.
At that time, however, we had two clauses included in the contract that should make the contract cancellable.
Point 1 was that it is only valid if we build in location XY.
Point 2 was that the financing is secured.
The financing was deemed okay by a financial advisor of the company (quote: "just barely feasible").
However, we have absolutely no trust left in the advisor and the seller! Due to the illness of the father, we cannot and do not want to put ourselves under the stress of building.
Do such clauses really exist and are they legal? Or should we expect an unpleasant surprise? Should I send the cancellation directly in writing to the company or to the seller? However, the seller has already lied to us once and put us under pressure, which is why we no longer want any contact! Or should I contact a lawyer who reviews the contract and possibly drafts the cancellation??? HELP!!!!!
