Hereditary leasehold land and real estate acquisition tax

Dear forum,

we are considering a leasehold property for our house. Our construction company mediates this property, but the contract for the house is independent of the leasehold contract for the land.

Question: Does the tax office calculate the real estate transfer tax only on the leasehold property or also on the contract for the house? I am grateful for any tips.

Hello,

You can find a lot of information here in the forum .....


Basically quite simple, if it is to be done legally: If you want to stay with the previous building partner, there is no way around paying the real estate transfer tax on land and house. Don’t let anyone tell you otherwise, the tax offices these days are not blind!

If you don’t want that - although with a leasehold land it doesn’t cost a fortune - you yourself either have to look for another plot or - if possible - lease the land and build with another builder.

Does all this also apply if the construction company has no benefit from the brokerage of the plots? In other words, if there is no commission or brokerage fee. It is only shown that one can lease plots from the church?
