GÜ will charge for the service

Hello everyone,

Since last year we have been comparing some house building companies. Now we have reached the point where we have decided on one.

Now we received an email from a GÜ (who received a rejection) saying that he wants to charge us for his expenses (floor plan etc.) because he apparently put in more effort than others.

We have been to the company several times for discussions. At the initial meeting, we clarified that the service is free of charge. And that we only want a price/offer from the company.

This has now dragged on over several discussions.

In my opinion, it is his business risk that he sometimes invests time/work and effort and then does not get a contract.

Of course, we did not sign anything on site.

What is my legal situation here? Do I really have to pay and if so, how much? Feel free to also contact me via PN.

Purely for the creation of an offer, in my opinion, he cannot charge anything if this was not explicitly agreed upon in advance. To what extent he has provided further services that you do not mention here, only you can judge.

Maybe this is also his tactic. Just try it and if only every 10th person pays the invoice, it is better than nothing..

Since the terms are often mixed up here -

who is this "GÜ"? Perhaps an architect who provides you with planning services and then has a third party build?

General contractor, who offers me a "fixed" lump-sum contract. He has his regular companies he works with and calculates for himself whether he can build the house with the contract amount plus his margin, with which he pays himself and his employees in the office.

I'm not very familiar with the terms. Please excuse my ignorance.

Demand emails end up in the spam folder?! ;) If a contract had been concluded, it would have an order number to refer to. His frustration is understandable, but not payable.

Provided you have no side agreements with this GÜ that you have currently forgotten, I agree with Musketier. Let him go ahead and issue an invoice, send it to "your relief" in the "original" (of course, you must document the process for yourself) and with a note referring to the agreement of a free quotation.
