Hello everyone,
My wife and I are currently in the process of building a single-family house in Lower Saxony. We had planned to construct a large garage with the dimensions 5.99x8.77x2.33m (shed roof). Due to our existing terrain, it is necessary to build on the border with the neighbor. The neighbor only has a paved driveway at the border. The 3m minimum distance cannot be maintained, therefore border construction.
As far as I know, it is required in Lower Saxony to have a building permit for garages larger than 35m² (correct me if this is not true). We will easily exceed that with about 54m². I had read that no more than 9 meters can be built on a property boundary, and a total of no more than 15 meters. This would be okay in our case since the garage will only be 8.77m long.
My question is: Can our garage be rejected in any way if the neighbor does not agree to it? We certainly do not expect any cooperation in any respect here.
