Garage boundary construction 9x6m Lower Saxony

Hello everyone,

My wife and I are currently in the process of building a single-family house in Lower Saxony. We had planned to construct a large garage with the dimensions 5.99x8.77x2.33m (shed roof). Due to our existing terrain, it is necessary to build on the border with the neighbor. The neighbor only has a paved driveway at the border. The 3m minimum distance cannot be maintained, therefore border construction.

As far as I know, it is required in Lower Saxony to have a building permit for garages larger than 35m² (correct me if this is not true). We will easily exceed that with about 54m². I had read that no more than 9 meters can be built on a property boundary, and a total of no more than 15 meters. This would be okay in our case since the garage will only be 8.77m long.

My question is: Can our garage be rejected in any way if the neighbor does not agree to it? We certainly do not expect any cooperation in any respect here.

I have a similar plan, also in Lower Saxony and with almost identical dimensions.
However, the point is different: What answer are you expecting here?
Are you not even submitting the building application if someone says the neighbor would have a say?
Or are you building without a building application if someone writes here that it would already be okay?

So for you, there is only one way to get a reliable statement on this, namely by building application or building inquiry at the building authority.

As long as you do not want to deviate from public law regulations, the neighbor has no influence on a building permit. Based on your previous information, I do not see any deviation. Possible deviations would be, for example, exceeding the maximum height of 3m or the location outside the buildable area of a potentially applicable development plan. PS.: IMHO it should be 30m², whereby it would have to be checked whether a double garage can be equated with two single garages, which would lead to exemption from the permit.

There is no development plan at our location.
I inquired again at our building authority this morning and was told that from the authority's point of view, there are no concerns regarding a refusal of the building permit.
The only thing that could stand in the way of granting the boundary development in our case
would be if the garage should be so high that living rooms would be overshadowed.
Whether this is the case must be determined by the architect or the planner of the garage.—In our case, I fortunately consider this unlikely.

The neighbor, I was told, cannot prevent the boundary development even if he does not approve of it, since less than 9m (including roof lengths) is built. (In total, only 15m can be built on all boundaries in Lower Saxony)

Yes, you are right. In Lower Saxony, it is 30m² instead of 35m² from which a building permit is required.
