Duties at the construction road (public space)

Hello dear forum,

Unfortunately, I could not find any help regarding my situation in existing posts, so here is my problem:

We are currently planning the construction of a single-family house on our property. The property can only be accessed via a public road, which is limited to 6 tons. The house contract states the formulation that I am responsible for "access roads up to the building structure," which should be passable by construction vehicles up to 50 tons. Does this responsibility also apply to the public road? Or only from the private property boundary? How is it with any costs for the "stabilization" of the public road – do I have to factor this in?

So far, I have always assumed that the construction company accepted the local conditions by confirming the order and possibly finds solutions to work with smaller construction vehicles.

I would be very grateful for your assistance.

There is no such thing. If the contractor believes (even retrospectively) that he needs a construction road for his machines or that the public construction road does not meet the conditions, then you are responsible for this. For a public road, you will need a permit and, after completion, also have to pay for the restoration/cleaning.

You will probably have to discuss the topic with the [Rathaus], it is likely a municipal path.

Thank you very much for the answers. I am still skeptical, however. Where does my responsibility end then? At the direct driveway? At the driveway of the driveway? At the driveway of the driveway of the driveway? To put it strongly exaggerated: Do I have to ensure that the highway is cleared when it snows? Do I have to refuel the truck for it to come to me? Are there legal frameworks or already adjudicated cases for this? That I, as the builder, have to obtain the permit from the municipality, I find completely legitimate.

You are only responsible for the access road, but it is a public street without restrictions. An exception permit from the city will probably suffice here, unless there is a bridge - then it simply stops. Our access road is actually not allowed to be used by trucks either... but fortunately, no one has cared about that.

Yes. You have to ensure that your construction site is accessible by a 50-ton vehicle. No. Yes. If you signed the contract as above and the road is damaged, the contractor will hold you liable. No. No. Either the road authority confirms to you that you are allowed to drive 50-ton trucks on the road during the construction period or under which conditions this is possible, or you have to have the house contract amended. Then the contractor must provide you with an offer regarding any additional costs you will incur or inform you that under these circumstances, construction with him is not possible.
