Hello,

we would like to ask for your help. We have been looking for a nice plot of land for quite some time. Meanwhile, we have found one. It is a real great plot, a rear plot. The access road is about 39m long and 3m wide.

If we now consider the setback area, then we can build our single-family house about 42m away from the public road, but we do not want that; instead, we want about 7 - 8 m away from the boundary, which then makes a distance of about 47m from the road.

Now, in the Brandenburg State Building Code under §5:


(1) From public traffic areas, a straight access or passage must be created especially for the fire department to rear buildings; for other buildings, this access or passage must be created if the second escape route of these buildings leads over fire department rescue equipment.

(2) For buildings where the upper edge of the parapet of windows or places intended for ladders is more than 8 m above ground level, an access or driveway must be created instead of an access or passage in the cases of paragraph 1.

(3) For buildings that are entirely or partly more than 50 m away from a public traffic area, access roads or driveways according to paragraph 2 must be provided to the land and movement areas located in front of and behind the buildings if they are required for fire department deployment reasons.

(4) ....

(5) Access roads and driveways, parking areas and movement areas must be sufficiently paved and load-bearing for fire department vehicles; they must be marked as such and kept clear at all times; the marking of the access roads must be visible from the public traffic area. Vehicles must not be parked on the areas according to sentence 1.


So, and exactly at this point our questions begin:

In §5/III it says, from 50m .... "if they are required for fire department deployment reasons." What exactly this means, no one can really tell us. It is referred to the preliminary building enquiry.

What do the building professionals think about this point? Thank you.
