Does a device house near the property boundary need approval?

In another forum, I was told that such a garden shed from the hardware store must be approved and is considered a boundary structure, especially if it has a paving underneath, which counts as a foundation.....I would have never thought of that. The only one who could be bothered by this would be the neighbor on the right, because his rhubarb now gets more shade. The shed is 2.12 x 2.12 meters and 1.93 meters high.

Yes, but I am not aware of any that would require a permit for such a small building, unless it is in an outer area according to §35 Baugesetzbuch. That just shows again how much nonsense is being spread. The worst part is that these are mostly half-truths, so that under certain conditions a denial would not be correct either. But even if it is permit-free, that does not mean it is allowed. A development plan, for example, could oppose it.

Ask neighbors, do it. If there is resistance, find a solution. Even though we live in single-family houses, we still live in a community, some like it more, others less. An office will most likely not take action on its own because of such a small house.
