I checked your profile. It's NW - that is the State Building Code NRW. §6 covers the setback area issue (only applies to buildings).
Aside from that, I recommend §69. Due to the general public interest, it could also override the setback areas (if any were to apply).

If you are somewhere on the edge, the prospects look bad. Otherwise, the timing might be good to submit a preliminary building inquiry.
