Disclaimer of liability when entering the property

Hello dear community. I am currently facing the following problem: I am the owner of a building plot in a new housing estate, but I want to build a house on it or have one built only in a few years. In the meantime, a neighbor wants to take care of the plot, i.e. mow the lawn, trim the hedge, etc. Among other things, he also wants to use the plot for recreation. Set up a barbecue area and a play meadow for the children . This is an oral agreement between me and the neighbor. I have known him from before. Now I want to clarify the whole thing legally and would like to draw up a kind of usage agreement. In this usage agreement, I want to waive any liability for various damages to the neighbor. For example, if the child gets injured on the property or the neighbor cuts off a finger with the hedge trimmer :-). Of course, I do not want to be held liable for such damages. As I said, I am in agreement with the neighbor. Now the question: How is best to clarify such a matter in writing in a legally correct way? I would be very grateful for a few tips. Best regards

As far as I know, you cannot exclude liability; after all, you remain the owner of the parcel. However, since I am not allowed to provide legal advice – which in Germany is exclusively reserved for the consulting professions – I recommend a discussion with a lawyer you trust.

There is property liability insurance available for little money (sometimes under €20 per year). If you do not want to build in 5-10 years, this is probably cheaper than having a legally secure contract drawn up by a lawyer. You have to read for yourself what is included in the insurance.

You can still make the lease agreement with your neighbor. There are several sample lease agreements available on the internet. I just downloaded one that stated the lessee is obligated to take out building or property liability insurance. Then the costs would even be shared.
