Development plan for a different house

Hello everyone, we are considering renovating at my parents-in-law's place. For this, we would have to rebuild it as a two-story building. According to the development plan, only gable roofs are allowed. There is a house where, according to the city, a house was "approved" despite this. Here, a hip roof was built, just as we wanted. Is an exemption possible here due to the fact that another house has already been built this way?

Since "slipped through" must be a rumor, it can actually only be an exemption. However, especially by phone, one quickly receives information of trainee quality.

Thank you very much. Do you know how it looks legally whether it is easier to obtain an exemption through the reference?

Otherwise, if it has slipped through (...would ask the owner myself!) there is no right to do it either, i.e. no right in being wrong!

You want an exemption, then you must apply for it. This is a peaceful administrative procedure. What matters here is that you request an exception in as few points as possible, then your chances are good. They will grant you the exemption, this will cost a fee. Only if it is denied to you and you saw that the principle of equality (or the binding of discretion) was violated and you filed a lawsuit against the decision, would I see relevance in presenting the neighbor’s exemption.

The building marked in red by me also has a hipped roof. So, have already 2 "slipped through"?
