Delay in land development

Hello!

Last year we bought a plot of land located on an area that is yet to be developed.

The handover was supposed to be last year. However, we had already expected a delay of about six months. At the beginning of this year, the seller promised another construction crew. Due to the weather, further development could only continue at the end of February, and the crew for this period was also promised.

A phone call in the meantime was supposed to bring additional workers by the end of March. But until today, they have not arrived.

Our purchase contract states that delays due to weather and planning-related issues are not the seller's responsibility... of course. But what about the constant promises and if he does not have control over his subcontractors? Do we have any options in this case?

The weather at the beginning of 2021 was difficult to predict. There was frost until May. If the year had gone like the previous years, the statement "February" would also have been correct. That's just how it is – unsuitable weather delays construction work. Then all construction sites pile up and there are resource shortages – both in terms of employees and subcontractors.

What options do you have?

    [*]You can act terribly and try to make an impression and sink some money into a lawyer. Won't help much.
    [*]You can let the whole thing take its course calmly, if you manage to. With that, you risk possibly being the last one for whom the delay is lifted.
    [*]You can look for a solution together with the seller. As a strong communicator partner instead of an opponent, you can support, bring in subcontractors and motivate the seller to take more interest in your situation.

I have mostly done very well with option 3 when it was important to me.

I have no problem with the fact that delays occur. I have a problem with the fact that promises are made again and again and nothing happens.

Hello everyone, from our point of view it is always better to find a solution together with the seller. The more you have documented in writing in advance and both of you have signed it, the easier it is for you to enforce your rights. Planning errors and construction defects are no longer an exception nowadays when building later. If these are discovered too late, significant financial damage can often occur here as well. In such cases, builder's legal protection is advisable.

The thread is over a year old.... if you’re bringing it up again just for advertising purposes, it would still have been somewhat decent to at least ask the thread creator how things have progressed :rolleyes:

That certainly helps the thread creator massively after more than a year. Especially since he has not been active since 09.05.2021.
