Defective window installation - hire an expert?

Hello

Unfortunately, it turned out that the window fitter messed up badly.

The side parts of the window sill were cut off and no sealing tape was installed.

I gave him the opportunity to make improvements. He did so, but in my opinion not completely.

Now it is a case of one statement against another.

I have reported everything in writing and taken many photos.

But what are the next steps now?

I have considered hiring an independent appraiser.

It probably won't work any other way when it's "statement against statement". If he accepts the expert's report: fine. If not: specialist lawyer for construction law. Otherwise, it's no use.

We perceived our contractor Heinz von Heiden in the most expensive individual case as immune to the defects described by the expert. Even expert criticisms from construction reports were sometimes simply built over unchanged, although rework was of course promised. For example, in the guest WC we opened the pre-wall, did the missing pipe insulation ourselves, and closed it again. From experience, it seemed likely to us that no one had caught up on this. The next working day, it was spackled.

If we had brought in an expert at that point, the money would have been wasted: An expert commissioned by one party is worthless in court. Therefore, my personal opinion is that one should immediately begin exclusively with legally enforceable measures. Setting deadlines by registered mail is part of this, a specialized lawyer is part of this.

Okay. Thank you for your feedback.

I am in the process of finding a specialist lawyer. Everything else no longer makes sense.

I am now faced with the decision to stop the construction work on the facade.

Of course, costs will then be incurred because of the scaffolding..
