Deep construction worker damages the road

Hello everyone,

until now I have always been a silent reader and have already been able to "take away" quite a bit.

However, I am not really making progress here:

Today the excavator I commissioned (one of those that the waterworks provide for selection) dug the trenches and installed the house connection for fresh and wastewater.

He was even so kind as to dig the trench for the gas connection as well (about 50cm long).

However, unfortunately he damaged the asphalt surface of the public road (new development area) with his mini excavator.

-> While excavating, he pressed his blade/shield into the asphalt surface and thus damaged the asphalt.

After my remark, I was told to press some bitumen in.

My question was how I should proceed now, since according to the building permit I am liable for damages caused by the municipality?

My plan is to call the company boss tomorrow and address the issue.

I am very grateful for tips and opinions, especially regarding the further course of action.

If this is the wrong thread, I apologize and ask for relocation.

You are indeed the client, but not the cause. Therefore, you have nothing to handle there. Call the boss and describe the situation.

Send a photo directly by email as proof.

You have no right to press anything anywhere on public roads. Liability reasons alone.

Hello,

I would also be careful about "patching up" anything on the surface of a public road.

During demolition and new construction, some curbstones were damaged – after completion of the construction work (and approval by the city), we had them replaced by our landscaping contractor.

Therefore, my recommendation as well:

Take a photo of the damage, send it along with a description of the situation to the head of the company, and ask for a proposed solution.

These things can happen; the company will most likely not make a big fuss about it...

Thank you for your answers.

I did not intend to "patch things up".

I have already informed the boss in advance by phone, an email with photos will follow.

I just want to have "something in hand" in case the regulatory office or the municipality ever contacts me and comes up with the idea of blaming me as the builder....

The municipality can still hold you liable as the builder. You simply have the responsibility.

But stay on the civil engineer.
