Hello everyone,
I am new here. My name is Maik, we carried out a renovation of our house and in the process also bought electric roller shutters. After the installation (mid-May 2022), I came from work to the construction site and had to realize that the roller shutter boxes are too big and protrude in front of the wall.
Since then, I have been trying to finally have new roller shutter boxes replaced, but the window company only keeps reassuring me that the new roller shutter boxes have been ordered. I do not get any more information. Even after countless emails and calls.

By when do the roller shutter boxes have to be legally replaced? Can I simply uninstall the roller shutters including the boxes and inform the company that they should pick up their shutters and then order suitable ones for me elsewhere? After all, I already have a new offer from another company. However, this will expire soon. Therefore, I currently do not know what to do.

Maybe someone here can help me.

Thank you very much.

Best regards
Maik

There are legal regulations for things like this. Usually, you have to report the defect in writing and demand a remedy, with a deadline. If the deadline expires, you then have certain means; I believe after several requests you can eventually demand a reversal of the contract. In your case, however, that would only be part of the service. (?) A lawyer can tell you more precisely about formalities / deadlines. But simple inquiries / requests by phone usually do not count. (at least that's my layman's opinion).

Hello and thank you for the response. I immediately pointed out via email that these are the wrong roller shutter boxes for the sake of clarity. How long must the fulfillment period be at a minimum? Is that known? Best regards Maik

An email is not a binding document in that sense. I would definitely do that in writing by registered mail. Otherwise, it is difficult to prove that an email has been delivered / read, and when. I am not very familiar with the deadlines; I would probably set 2-3 weeks. But you can try googling for defect notification / deadline setting or something like that. Only a professional / lawyer can give you binding advice.
