Conversion of single-family house to three-family house, existing protection? Roof insulation?

Question for the Building and Energy Saving Ordinance specialists.

A house is currently a two-family house (legally a single-family house). It consists of a ground floor, upper floor, and attic. However, there is a separate apartment on each floor. In 1985, the attic was converted into a separate apartment. This was never a problem because the entire house was occupied by one family. It was never approved. According to the current statement from the building authority, this is not a problem.

I would like to reclassify it as a three-family house, then divide it into condominium ownership and sell the apartments individually.

This has already been roughly clarified with the municipality and would not be a problem. Parking spaces can be realized. The apartments are accessible via a common staircase, only new apartment doors need to be installed.

Now comes the critical point. The attic was converted in 1985. Back then, simply rock wool was installed as insulation between the rafters and a ceiling was constructed between the floors, which was largely filled with rock wool. There is an access hatch to a roof space. It is not insulated. Of course, no regulations were observed at that time. It certainly does not meet the current energy standards. The insulation is partly only 12 cm thick.

If I now have an approval made for a 3-family house, do I have to bring the house's energy performance up to the currently legally required standard? In other words, must the roof insulation then comply with the current applicable standards? If yes, then I would basically have to gut the entire attic.

Perhaps someone is knowledgeable about this and can say something in advance. Or who could make a legally certain statement about this? I briefly spoke on the phone with a loosely known energy consultant. Unfortunately, he was very curt and only said that the existing rights should apply and nothing would have to be changed.
